Pregnant Woman Arrested on Drug Smuggling Charges Before Plane Trip
Posted By Rivas Law Firm

A pregnant woman was arrested by the DEA (Drug Enforcement Agency) for ingesting drugs while pregnant. Ms. Esoche, along with four other suspects, tried to smuggle cocaine while on a flight to Rome. According to Hamza Umar, the airport commander, it was his view that the suspect had no respect for the dignity of her child.

Ms. Esohe communicated to officials  that she had been rejected by the man who impregnated her. She claimed she needed to fend for herself in order to survive. She agreed to smuggle the drugs on the promise of 2,000 Euros, claiming that she needed the money to take care of herself and her unborn baby.

Juvenile Girls Exhibit Greater Behavioral Problems in the System
Posted By The Rivas Law Firm

According to research, it has been found that girls are more problematic when it comes to their behavior in the juvenile justice system. They seem to have more problems in areas like family, mental and physical health, responsibility, and traumatic events, but boys were ahead when it came to having more previous criminal offenses. Stephen Gavazzi, who co-authored the study, believes this conclusion leads to the suggestion that the juvenile justice system needs to become more geared toward handling the female issues and put more resources in place.

The study was done on slightly over 300 youths who were living in the detention facility of a large juvenile court in Ohio .

Juvenile crimes are troublesome in almost every state throughout the country. An analysis of the FBI’s National Incident based reporting system data from the years 1997-1998 shows that 19 percent of the victims of nonfatal violent crimes were victimized by a juvenile offender —either a juvenile acting alone, multiple juveniles, or juvenile and adult offenders acting together.

Man Suspected of Killing Wife with Chainsaw
Posted By Rivas Law Firm

As of yesterday, 49-year-old Texas resident Jose Fernando Corona is under suspicion for the murder of his wife, 44-year-old Maria Corona, a mother of six children. She was found decapitated and died of wounds inflicted by a chainsaw, the local medical examiner stated. A warrant has been issued for Jose Corona’s arrest in connection with the incident. The Dallas Morning news reported that a mail carrier discovered Maria's body near her home.

According to Lewisville police Captain Kevin Deaver, the couple had been having marital problems and it’s believed that Jose fled the scene in a gold Ford Ranger pick up truck. A chainsaw was found still running on the tailgate of a truck in the home’s driveway. It was noted that Corona had no previous criminal record.

  White Collar Crimes: An Overview
Posted By Rivas Law Firm

Some people consider white collar crimes less evil than other types of crimes, but legally they can get you into a lot of trouble. Included in the category of white collar crimes are computer crimes, embezzlement, public corruption, environmental crime, identity theft, consumer fraud, financial fraud, forgery, medical crime, bribery, and bankruptcy fraud, just to name a few.

According to FBI research statistics, white collar crimes cost the U.S. in excess of $300 billion annually, and white collar crimes often go undetected.

A few of the more commonplace white collar crimes below have become increasingly popular in modern times:

Cell phone fraud

This involves the unauthorized use or tampering of a cell phone or service. Stolen phones are sometimes used or people sign up for service using a false ID. Cloning of valid electronic serial numbers {ESN} and reprogramming it into another phone also occurs.

Computer fraud

Hackers sometimes steal information sources that are contained in computers such as credit card information, bank information, etc.

Credit card fraud

This involves someone using a credit card in an unauthorized manner to obtain goods or services.

White collar crimes can lead to jail sentences and heavy penalties. If you or someone you know of has been arrested or charged with a white collar crime, you will need an experienced Orlando criminal defense attorney to help you fight your charges. Contact our office today at 888-249-1206  to set up a consultation with an attorney the firm.

  Some Facts about Drug Crimes
Posted By The Rivas Law Firm

Both the state of Florida and the Federal Government have laws regarding the unlawful use, distribution, possession or production of specific kinds of drugs. The laws are designed to reduce the illegal use of drugs and curb drug related crimes. This includes drugs like heroin, cocaine, methamphetamines, and marijuana.

Drugs are categorized into what are called schedules, of which there are five. Schedule one drugs are the highest in category and are the most potent based on susceptibility to becoming dependent on them and do not have an acknowledged medical use. Schedule five would be the least potent with the least likelihood for dependency. The penalties connected with schedule one drugs are far more severe than the penalties for a drug crime involving a substance in a lower schedule.

Drug Crimes & Penalties

The penalties for a drug crime are dependent on several factors. These include:

  • The quantity of the drug
  • The classification (schedule)
  • The purpose of the possession (intent to sell)
  • What type of drug was in the defendant's possession

The drug crimes which are considered the most serious are as follows:

  Sleepwalking, a Most Unusual Defense
Posted By Rivas Law Firm

It may seem unusual, but there have been murderers who have not been convicted for their crimes due to sleepwalking.People who have the condition of parasomnias can involuntarily act out unusual behavior patterns. This behavior is usually harmless, but not always. They can sometimes do reckless things, injure themselves or others and have no idea that anything occurred for they were “asleep.” Due to this most unusual circumstance, a legal defense came into being called “sleepwalking defense” whereby the defendant is not held responsible for his actions as he or she was asleep and was not consciously intending to commit a crime. This defense is sometimes successful, and sometimes not.

One particular case, Fain vs. Commonwealth, which occurred in the 1870’s, involved a man who fell asleep in the lobby of a Kentucky hotel. When the porter tried to wake him, he pulled out a gun and shot him three times. The man was found guilty of manslaughter but the ruling was later reversed upon appeal. Evidence was presented in the appeal that he had a life-long history of sleepwalking and was sleep deprived before the attack occurred.
