The Expungement Process

Orlando Expungement Attorney

In Florida, there is a specific process that may allow a person with a criminal record to  expunge (remove from Florida Department of Law Enforcement records) or  seal (place under highly restricted access) information about arrests or convictions. However, expungement is a legal process and may be complex. For this reason, we highly recommend that you consider working with an  Orlando expungement lawyer to ensure your expungement is handled properly and efficiently.

To apply for expungement in Orlando, Florida, you must turn in the following to the Florida Department of Law Enforcement (FDLE):

  • A completed, signed and notarized Application for Certification or Eligibility, including Section B of the application, which must be completed and signed by the proper State Attorney or statewide prosecutor.
  • A check or money order for $75, payable to FDLE (Florida Department of Law Enforcement).
  • A certified copy of the disposition of the case that is to be expunged.
  • Fingerprints, recorded by a law enforcement agency, on an applicant card.

If all of these items are not present or filled out properly, your application will be returned, unprocessed.

The expungement processing time in Orlando may vary depending on the number of applicants as well how busy the agencies handling these items may be. According to the Florida Department of Law Enforcement website, the current processing time at the time of this writing is 40 days, due to backlog.
